Owners requesting bank statements and management accounts

Member’s question:

Good day Paddocks,

The bank statements and management accounts are sent to the trustees monthly. However owners are now requesting the same information from the Managing Agent. Must they be viewed at the Managing Agent’s office or can they be emailed, if the trustees approve?

Graham’s answer:

Dear member,

Yes, you can and should email the documents so that the owners can inspect them at home, rather than at the Managing Agent’s or Body Corporate’s offices.

The Body Corporate can also charge a reasonable fee for your time in understanding the request, preparing the documents and sending them by email.

Issuing of levy clearance certificate where multiple units are owned

Member’s question:

Hi Graham

We have an owner who is selling their unit, and they are allegedly unable to pay the outstanding electricity recovery in full and wish to give the Trustees a proposal to pay this amount over 12 months (which will be after the unit has been transferred). It is a substantial amount.

The seller still owns other units in the building, which are also up for sale.

This is the first time I have ever had such a request and I am not even sure if this can be considered, although, personally, I would be extremely reluctant for the Trustees to consider this.

Graham’s answer:

Dear member,

I agree. The owner should pay this amount before the clearance is issued.

Unless the owner actually pays the amount, on transfer the Body Corporate will lose its statutory ’embargo’ rights. It will still have a claim for the debt, but it will be more complex to enforce.
