Who must open a new scheme’s administration fund account?

Good day Paddock Team,

With the establishment of a new sectional title scheme, who opens the administrative bank account for the body corporate?

Dear member,

It should be the persons who are elected to hold office as trustees, as they exercise the body corporate functions and powers.

Can a body corporate oblige owners to sign debit orders for levies?

Member’s question:

Hi Graham

Kindly advise if a body corporate can force owners to sign a debit order to pay their levies. Can they make this a conduct rule if owners at the Annual General Meeting agree to this?

Dear member,

As the payment of levies is a management issue, I think an obligation on owners to put in place a debit order or any other automatic levy payment system could only validly be included in a management rule.
