Attendance by owner at trustee meetings

Member’s question:

Hello,

An owner is permitted to attend a Trustees meeting – they can speak but do not have a vote at that meeting.

If the owner in question becomes disruptive, can the chairman/trustees demand that this owner leave the meeting?

Is the owner permitted to record the meeting?

Anton’s answer:

Hi,

If a person disrupts a meeting to the extent that it’s business cannot be done, the chairperson is entitled to have that person removed from the meeting.

Prescribed management rule 9(e) requires the trustees to keep minutes of meetings, not owners. If the trustees use a recording of the meeting as a minute taking tool, they may do so.

It sounds as though this owner at least thinks the trustees are not trustworthy. That is the issue to settle

 

Inspection by a trustee

Member’s question:

Hi,

If an owner has done cosmetic alterations to his unit, may a trustee inspect on completion or may it be denied by the owner.

The biggest alteration was removing the bath and replacing it with a walk in shower.

Anton’s answer:

Hello,

An owner does not need the consent of trustees to do internal alterations, but the trustees are entitled to ask to inspect the section to check that there is no structural compromise to the building and, for example, plumbing connections to the common property have been properly made.
