November 2012 (Volume 7, Issue 11) |
In October I attended the Strata Community Australia (NSW) annual conference with Jennifer, and this month I spoke at a NAMASA (WC) conference. It is really interesting to compare the strata title and sectional title industries, and comforting to note that South Africa is way ahead of Australia in the area of managing agent training.
This month's edition of Paddocks Press includes: 1. Anton Kelly – The right of the developer to extend a sectional title scheme and what that right means for the body corporate 2. Brian Addison – Insurance payouts in damaged schemes – who gets the insurance payout? 3. A Paddocks Club video – Leaky pipes in exterior walls 4. More Q & A.
Take care, |
Kind regards,
Graham
P.S. We are still accepting late registrations for the UCT (Law@Work) Sectional Title Scheme Management course. Contact emma@paddocks.co.za to find out more.

Developer's right to extend scheme
What does this mean for the body corporate?
By Anton Kelly
In developments that are sectional title schemes, adding phases after the establishment of the body corporate is not the automatic prerogative of the developer, it is a right that has to be formally acquired and brings with it liabilities and responsibilities to the body corporate of the scheme. The right to extend the scheme, also called a future development right, is a registered real right and is deemed to be a right to immovable property.
In this article, Anton explains how the developer acquires the right to extend the scheme and what the body corporate can expect from the developer. (reading time: ± 3 mins)

Insurance payouts in damaged schemes
Who gets the insurance payout?
By Brian Addison
Section 37(1)(h) – “Functions of the Body Corporate” directs that the trustees, acting on behalf of the Body Corporate, must apply any insurance money received by it, in respect of damage to the building/s, in rebuilding and reinstating the building/s. The Body Corporate is “the insured” and monies paid in settlement of any insurance claim must be paid into the account of the Body Corporate. Trustees are obligated to see to it that repairs are undertaken, even repairs to sections internally i.e. fitted carpets, ceilings, fitted cupboards, sanitary ware, etc.
In this article, Brain gives his views on who receives the insurance payout when a unit or buiding in a scheme is damaged. (reading time: ± 1 min)
