On 16 April 2010, the Department of Rural Development and Land Reform amended the Regulations made under the Sectional Titles Act, 1986. The Notice deals mainly with registration matters. But the last item amends prescribed management subrule 39(2) that deals with delivery of the annual financial estimate, financial statements and trustees' report to owners and bondholders in advance of the Annual General Meeting. Liability for maintenance and repair

The difficulty with determining who is liable for the maintenance and repair of windows in a scheme is to determine if the windows form part of the owners’ sections – therefore making the owners liable for their maintenance and repair – or whether they form part of the common property, in which case the body corporate would be liable to repair and maintain them.
