December 2011 (Volume 6, Issue 12)

Dear Paddocks Press Fan,

Prof. Graham PaddockWelcome to the last Paddocks Press for 2011. It has been a momentous year for the Paddocks, with both Sam and Robert getting married. Our new baby, Paddocks Club, is thriving. I will be adding private online consulting services to this platform in 2011 and we will re-introduce free access to the sectional plans we have on record, which can be searched for by scheme name.

In this edition of Paddocks Press:
1. Anton looks at short-term sectional letting during the holiday season
2. Clint unpacks the revised PMR for levies and budgets
3. We include a history of the Sectional Title Survival Manual
4. There is a "Heads Up" guide to the requirement for a Promotion of Access to Information Act Manual which must be produced and published by year end
5. As always, I share a few Q&As

Be careful, as always, over the holidays!

Kind regards,

Graham

P.S. Late registrations are still being accepted for the 13th presentation of the University of Cape Town (Law@Work) Sectional Title Scheme Management course.

Anton Kelly

By Anton Kelly

Owners who live in their units and tenants in schemes situated in holiday destinations tend to see holidaymaker tenants as a pest. But why shouldn’t an owner in a scheme that happens to be in a holiday destination take advantage of the demand for short-term accommodation in the holiday seasons? What do the prescribed rules say about short letting?

In this article, Anton outlines three principles in sectional title legislation that could have a bearing on short term letting. (reading time: ± 2 mins)

Amendments to the PMRs

By Clint Riddin

It has long been a recognised need in sectional title financial practice to have the levies set at the level necessary to meet the operating and financial needs of the body corporate, for the budget year and financial year to be the same and the new levies to be in place from day one. Read what has been effected in relation to the recent amendments of the PMRs

In this article, Clint outlines the revised rules for levies and budgets according to the recent amendments in the PMRs. (reading time: ± 2 mins)
