August 2014 (Volume 9, Issue 8)
Dear Paddocks Press Fan,
The recent press reports of managing agent misappropriation of scheme funds underlies the necessity for trustees to ensure that:
A. their scheme's funds are not mixed with those of other schemes, and, B. they check bank balances regularly as well as inspect monthly management accounts.

These reports also underscore the necessity for scheme funds to be protected by fidelity insurance against theft by any person who has the authority to operate the relevant account. The scheme that lost R400 000,00 will probably get its money back in due course, but the average 5 to 7 year delay in getting paid by the EAAB’s fidelity fund means that many of the current owners will no longer be part of the scheme when that happens!

In Paddocks Press this week we have:

1. Can a Body Corporate Lend Money to its Employees? - Anton Kelly
2. Are Policies Always in Line With Sectional Title Requirements? - Mike Addison
3. Liability for Levies When a Unit Changes Hands - Jennifer Paddock
4. The Validity of a Penalty Rule and Enforceability of the Fine Implementation -         Carryn Melissa Durham
5.  Monthly Q&A - The Paddocks Club Team

and we give you details of our upcoming training courses.
Kind regards,
Graham

P.S. Registrations are now open for the Sectional Title Trustee Training Course as well as the Sectional Title Meetings Course

Liability for Levies When a Unit Changes Hands

Ordinary/general levies are straightforward as they are catered for in the Sectional Titles Act. However, when it comes to special levies there is no provision in the Act that caters for a change of ownership and therefore it is not as straightforward.

This months blog post, Jennifer Paddock discusses liability for levies when a unit changes hands. (reading time ± 2 min)

Carryn Melissa Durham The Validity of a Penalty Rule and Enforceability of the Fine Implementation

For the penalty rule to be binding on the body corporate the fine recoverable must be entrenched in the governance documentation of the scheme. This means that it needs to be contained in either the management or conduct rules.
