Voting rights
Does a body corporate have a vote for a unit it owns?
By Graham Paddock
The Sectional Titles Act, 1986, allows a body corporate to purchase a unit when this is essential for the proper fulfillment of its duties. The Act does not distinguish between units in the scheme administered by the body corporate and those in other schemes. This means that a body corporate can, when absolutely necessary, purchase and take transfer of a unit in its own or in another scheme.

In this article, Graham deals with the voting rights in respect of units owned by a body corporate. (reading time: ± 2 mins)

Success in sectional title developments
Paul Henry
Success dependent on trustees and managing agents
By Paul Henry
The success or failure of sectional title schemes today is dependent to a large extent on the body corporate trustees and their managing agents. However, this simple fact is often forgotten by the developers who appoint the managing agents for the first year and by the body corporate members or owners who have to elect the trustees who will run the development going forward. Installation of pre-paid meters
Pre-paid meters in sectional title schemes
By Anton Kelly
One of the major financial problems encountered by many sectional titles schemes these days is the recovery of services costs. Quite simply, owners and tenants just don’t pay their electricity and water bills. The problem that schemes encounter is that widespread non-payment can lead to huge outstanding accounts.

In this article, Anton looks at the installation of pre-paid meters. (reading time: ± 2 mins)

Cheat Sheet: Summary of consent levels for body corporate decisions
By Jennifer Paddock
In sectional title schemes there is often confusion about what level of body corporate consensus is required for certain decisions. Is a simple majority enough or do we need a special or unanimous resolution? When is the written consent of all owners required?

In this article, Jennifer provides a summary of some of the decisions set out in the Sectional Titles Act and the Prescribed Rules and what level of consensus is required for them. (reading time: ± 1 mins)
