 body corporate, home owners association, shareblock scheme, retirement

implemented SARS Interpretation Note 64, which deals with how a 
community scheme is taxed by SARS.</div>

people serving as trustees concerns “owner apathy”. They say it can be 
nearly impossible to get anything non-routine done – decisions that can 
only be taken by owners can’t be dealt with as there are often 
insufficient owners present at meetings to form a quorum. This is said 
to be particularly true in schemes where there is a high proportion of 
investor owners.</div>

            <title>Fiduciary duties of HOA executives</title>

            <description><![CDATA[<div><b>By the Newsletter team</b><br /><br /><div align="justify">Common law states that a Home Owners’ Association (HOA) executive has a 
special legal relationship to their HOA. They owe the HOA a duty of 
trust, reasonable skill and confidentiality. This is referred to as the 
"fiduciary relationship" and it implies that the executive must put the 
interests of the HOA ahead of their own interests.</div>
