Attending your Sectional Title's AGM
What can an owner achieve by attending the AGM?
By Anton Kelly
Attending AGMs is the sectional title owners’ only real chance of influencing how their scheme is run. The prescribed rules specify a number of very important items that must be considered and decided on by the owners at the AGM. These decisions directly affect owners’ lifestyles and pockets, so it’s worth the time and trouble of attending and taking part in those decisions.
In this article, Anton explains why it is important for owners to attend their AGMs. (reading time: ± 2 mins)
Water damage seeping into downstairs flat
Is there basis for an insurance claim?
By Bruce Gibson
The intention of the Sectional Title policy is to insure the buildings/structures relevant to the body corporate, as required by Prescribed Management Rule 29 of the Act. It is therefore, clear that the washing machine, not being part of the body corporate property, cannot form part of the sectional title policy. However, water is an insured peril and, as such, the body corporate should have a valid claim for the damage caused by the faulty washing machine.
In this article, Bruce gives his views on two issues which need to be considered when there is water damage resulting from another unit's faulty washing machine. (reading time: ± 2 mins)

Member directives to executives in HOAs
Owners, as a group, have more power over trustees
By Anton Kelly
Owners in sectional titles schemes don’t always realise that, as a group, they can tell the trustees how to deal with a specific issue. Both the Act and the prescribed rules make that provision. Do owners in a home owners’ association enjoy the same prerogative?

In this article, Anton discusses members directives to executives in HOAs. (reading time: ± 2 mins)
