December 2009 (Volume 4, Issue 12)

Dear Paddocks Press Fan

Prof. Graham PaddockTo all our friends and students, we wish you an enjoyable and restoring break over the year end, a blessed Christmas with your families and a safe return to work in 2010. See you in the New Year!

In this final December 2009 issue:

1. I look back at 2009 and highlight a few issues that have arisen;
2. The Training Team looks at the roles and duties of managing agents in the context of sectional title meetings;
3. Jennifer looks at the difference between repairs and maintenance in schemes;
4. Rob compares building envelope sealants with football goalies (an early case of World Cup Fever perhaps?);
5. The process of printing the new format of Paddocks Press is demystified by the Training Team;
6. Jennifer deals with sectional title issues in her Q & A column; and
7. Finally, we give you details of forthcoming attractions in the community scheme training space.

Regards,
Graham

Looking back at 2009

A Sectional Title Retrospective

By Prof. Graham Paddock

As we approach the end of 2009 it is interesting to look back and consider what issues have arisen in the Sectional Title industry over the past 12 months. Here are some:

  • When will the provisions in the Sectional Titles Amendment Bill 2009 become law?
  • Are owners in arrears with levies protected by the consumer protection provisions in the National Credit Act?
  • Are Managing Agents 'debt collectors' for the purposes of the Debt Collectors Act?
  • Should the CSOS regulate Managing Agents?
  • When will the CSOS come into operation and where will its offices be situated?
  • How and when will the Department of Human Settlements make sectional title tenure more suitable for housing delivery?

Improvements vs. maintenance and repairs in sectional title schemes

Jennifer Paddock

Distinguishing the two topics

By Jennifer Paddock

It can be difficult to distinguish between maintenance and repairs on the one hand, and improvements on the other. In a situation where the trustees are unsure of the nature of the proposed work they will be uncertain whether the particular expense requires the owners’ permission or not.

This article takes a thorough look at these issues as well as the sections of 'The Act' and the prescribed management rules that deal with maintenance, repair and improvements. (reading time: ± 3 mins)

Sealants and goalies - one and the same

Robert Paddock

Maintenance

By Rob Paddock

In this article for Paddocks Press, we will be looking at sealants. If sealants were to be personified, they would most certainly be the goalie of a winning team on the soccer field - the ultimate defender.  The main purpose of using sealants on the building envelope of your sectional title scheme is to fill joints and gaps between different building materials and to form a seal that keeps air infiltration and water penetration at bay.
